3090 Members, Other City Coalition Unions Not Impacted By Layoff Directive

Dear Local 3090 Members,

Despite the Urgent Directive issued by the Mayor on Feb. 4, 2010, that he will eliminate 1,000 positions from the General Fund, Local 3090 and other City Coalition union members will not be affected.

The Coalition contract states: “… any employee represented by any union that is a member of the Coalition of Los Angeles City Unions will not be subject to layoff or a mandatory unpaid furlough program during the period from July 1, 2009 to June 30, 2011.”

“… In fiscal year 2010-2011, if the City elects to lay off any member in any classification represented by the Coalition bargaining units, all wage movement outlined in the MOU extension will be advanced by one year (retroactive if necessary) for all Coalition bargaining units.”

Layoff Avoidance

Pursuant to the Coalition Agreement, “The City shall utilize all appropriate layoff avoidance tools, (e.g., transfers, Charter section 1014 transfers) to avoid layoff in General Fund positions. In the event an appropriate transfer is refused by an employee, the parties agree that the layoff protection pursuant to this Agreement is waived for that employee.”

The Mayor’s Directive indicates that he intends to complete the transfer of employees from general funded to special funded and proprietary departments by Feb. 15, 2010. Personnel Department will facilitate and implement the transfer process. To that end, we urge our members to take the following affirmative steps:

  1. if management requests that you transfer to another “reasonable position” as a result of the elimination of your unit or your work, honor such a request or your layoff protection under the Agreement is “waived”;
  2. contact your Union Representative if you have any questions before turning down a request;
  3. volunteer to transfer.
